Wii Canadian DMCA = Modchips Illegal In Canada

Quote:
It’s official, the Canadian DMCA has made the jump for the Order Paper to its First Reading in the House of Commons. Prentice finally made good on his promises to countless US trade groups, corporations and lobbyists and presented this bill with no public consultation with the Canadian public. Now it’s the public’s turn to voice their displeasure with “Made in America” laws being introduced in the Canadian Legislature.
The complete text of Bill C-61 can be found here.

all good things must come to an end....the end for Canadian modchip stores is near, once this bill is passed any store owner with half a brain will probably shut down for good...unless you want to be an example just like easybuy2000 was when the gray market Satellite bill was passed and RCMP raided that web stop in Quebec. .

No offense to anyone, but isn't canada supposed to be england's bitch or something? They were just declared legal in england, so shouldn't canada follow suit and keep them legal?

Took a quick skim of the actual document and came up with somthing very interesting..

(2) Paragraph 41.1(1)(b) does not apply to a
person who offers services to the public or
provides services for the purposes of circumventing
a technological measure if the person
does so for the purpose of making the computer
program and any other computer program
interoperable.

Now im no lawyer but if im reading this right, it will still be legal to use a modchip as long as said modchip is designed to make a computer program interoperable.

What im thinking is that as long as a modchip permits you to play other forms of media on your wii console that would not normally be playable on the wii (like making the wii load a computer game like doom) you can still legally sell, install and use a modchip.

Does this make any sense to anyone else?

Yes but thats a Port so its basically still a wii game. Now with the ability to run homebrew maybe they could call it that. Maybe the new Korean wiis will be able to play GC with a chip and that will make the chip legal but that would be for Korean wiis so really worthless for Canada.
