wow. That is simply stunning. I am floored by where this project is going. Right now I shy away from Wii homebrew since it's kind of a hastle to run what with the TP hack. I actually use my ps2 more for homebrew with the independence exploit. But as soon as the HB channel is out, well, I just can't wait. This is going to transform the Wii to do so many things! We have exciting times ahead of us to say the least.
well thats what alot of people will want to know, im guessing only nintendo knows the ture answer
nintendo can detect it, if they want to. The issue is, how will they react? Hopefully they will neither ensure compatibility or deliberately sabotage wiibrew with subsequent updates.
Only nintendo knows.

I wonder in how far nintendo will mind homebrew like this (although this almost exceeds homebrew), as this is not (directly) related to piracy, but just extends the possibilities of a wii, which in turn will make it (even) more attractive to the public I guess,..

Keep in mind it also gives users an easy way to launch emulators, thus cutting Nintendo's VC profits. I'm pretty sure they'll smack this down with everything else when they decide to pounce.
Its important to remember that just because someone says something is illegal, or you are told not to do something in terms and conditions, does not make it automatically law.
I reckon we are well within our rights to hack the wii and put custom programs on it, providing they don't breach copyright.
Nintendo can stop these hacks from working, but if they brick our wii's because of them, and it can be proven deliberate, they could have a lawsuit on their hands.
If they do block these programs from working, its no biggie, because there are many ways to skin a cat, and many ways to hack a wii. I am confident that when trucha eventually gets patched, new alternatives will arise, but people are reluctant to announce these prematurely, as nintendo will only block them sooner.

Who said anything was illegal? However, in the US and many other countries, circumventing copy protection IS AGAINST THE LAW.

Someone could certainly try. But they will fail. Nintendo is well within their rights. If you manually alter the console (hardware or software) and an update bricks it you have ABSOLUTELY NO recourse.
If someone doesn't like that then they can stop using it. It's that simple.
