Who said anything was illegal? However, in the US and many other countries, circumventing copy protection IS AGAINST THE LAW.

Someone could certainly try. But they will fail. Nintendo is well within their rights. If you manually alter the console (hardware or software) and an update bricks it you have ABSOLUTELY NO recourse.

If someone doesn't like that then they can stop using it. It's that simple.
